จากการที่ได้มีการยก ร่างพรบ.คณะกรรมการสิทธิมนุษยชนแห่งชาติ เพื่อให้สอดคล้องกับรัฐธรรมนูญ 2550 และได้มีการแก้ไขกฎหมายอยู่หลายมาตรา

จึงขอนำเสนอ พรบ.กสม.ฉบับปี 2542 และ ร่างพรบ.กสม.ฉบับกฤษฎีกา และ รัฐธรรมนูญ 2550 ว่าด้วยเรื่องคณะกรรมการสิทธิฯ เพื่อเปรียบเทียบและแสดงความเห็น ก่อนที่จะมีการพิจารณาผ่าน ร่างพรบ.กสม.ฉบับกฤษฎีกา ต่อไป

Draft law prohibits National Human Rights Commission from revealing information about cases under investigation

Current and former National Human Rights Commissioners are concerned about changes made by the Council of State to a new law governing the independent body.  The Commission will be prohibited from revealing any information about cases under ongoing investigation, while it will be authorized to pursue court cases on behalf of those whose rights are violated.

In a Matichon report on 29 Nov, National Human Rights Commissioner Niran Pitakwatchara said that the Council of State, the government’s advisory body on legal matters, had made substantial changes to the proposed new National Human Rights Commission law, drafted by the former Commission.

The Council of State has sent the draft to the Commission and affirmed that it will soon submit its version to the Cabinet for approval.

An urgent meeting was called on 30 Nov for members and former members of the NHRC as well as law academics to discuss the latest version.

The major changes which have been made by the Council of State and which are challenged by both present and previous commissioners include Section 43 which prohibits commissioners, members of NHRC sub-committees and NHRC officials to reveal information acquired under authorization under the law, except for the results of cases approved by the Commission or information given in court prosecutions.

Section 51 punishes offences under Section 43 with imprisonment of up to 6 months, or a fine of up to 10,000 baht, or both.

According to Niran, these clauses have appeared out of nowhere; the previous draft did not mention these at all.

The NHRC has written to the Council of State to reject these, but the latter has ignored the rejection, and instead forwarded the draft to the Cabinet, he said.

Sunee Chairos, a former NHRC member and a drafter of the original version, said that the inclusion of Section 43 would complicate NHRC work with complaints and interpretations of the law, further delaying already delayed cases.  The Council of State should not have intervened in the content and detail of the law, and should have let Parliament consider what should be changed.

As the original NHRC draft has gone through many public hearings, it should be almost complete.  Apart from the addition of the two Sections, the clause concerning the NHRC Fund was left out without any explanation, Sunee said.

The meeting on 30 Nov was also supposed to discuss proposals to change the composition of the 7-member selection committee which appoints the NHRC, replacing representatives of the assemblies of the Administrative Court and the Supreme Court with those from the civil sector.

However, the Council of State’s version of the draft authorizes the NHRC to file complaints with the Constitutional Court (Section 44), the Administrative Court (Section 45), and the Court of Justice (Section 46), and to appoint public prosecutors or lawyers to act on behalf of victims in court.

นพ.นิรันดร์ พิทักษ์วัชระ กรรมการสิทธิมนุษยชน (กสม.) เปิดเผย “มติชน” เมื่อ วันที่ 29 พฤศจิกายนว่า ในเวลา 13.00 น. วันที่ 30 พฤศจิกายน กสม.ทั้งคณะจะจัดประชุมร่วมกับ กสม.ชุดเก่า และนักกฎหมาย ประกอบด้วย นายวสันต์ พานิช นางสุนี ไชยรส อดีต กสม. และนายบรรเจิด สิงคเนติ นายกิตติศักดิ์ ปกติ อาจารย์ประจำคณะนิติศาสตร์ มหาวิทยาลัยธรรมศาสตร์ เป็นต้น เข้าประชุมเร่งด่วน กรณีที่คณะกรรมการกฤษฎีกาได้แก้ไขสาระสำคัญของร่างพระราชบัญญัติคณะกรรมการ สิทธิมนุษยชนแห่งชาติ พ.ศ. (ร่าง พ.ร.บ.กสม.) ฉบับใหม่ ซึ่งในหลายประเด็นไม่ตรงกับร่างที่ กสม.ชุดเก่าเคยยกร่างไว้และผ่านการรับฟังความเห็นจากทุกฝ่ายที่เกี่ยวข้อง แล้ว นอกจากนี้ สำนักงานคณะกรรมการกฤษฎีกาได้ส่งร่างดังกล่าวมาให้ กสม.และยืนยันว่าจะเสนอเข้าสู่ที่ประชุมคณะรัฐมนตรี (ครม.)ในเร็วๆ นี้

นพ.นิรันดร์กล่าวต่อไปว่า สาเหตุที่ กสม.ทั้งชุดเก่าและชุดใหม่ต้องเรียกประชุมด่วน เนื่องจากยอมรับไม่ได้กับร่างที่กฤษฎีกา เพิ่มเติมเข้ามา ได้แก่ มาตรา 43 ระบุว่า “ห้ามมิให้กรรมการ อนุกรรมการ และพนักงานเจ้าหน้าที่ เปิดเผยข้อเท็จจริงที่รู้หรือได้มาเนื่องจากการปฏิบัติการตามอำนาจหน้าที่ ตามพระราชบัญญัตินี้ เว้นแต่เป็นการเปิดเผยรายงานผลการตรวจสอบตามมติของคณะกรรมการ หรือเป็นการเปิดเผยในการดำเนินคดีในศาล” และมาตรา 51 ระบุว่า “ผู้ใดฝ่าฝืนมาตรา 43 ต้องระวางโทษจำคุกไม่เกินหกเดือน หรือปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ” ตรงนี้ถือเป็นการแก้ไขที่ไม่รู้ที่มาที่ไป เรียกว่าแก้แบบไม่มีปี่ไม่มีขลุ่ย และไม่มีใครทราบมาก่อน เพราะร่างฉบับเก่าไม่ได้พูดถึงเรื่องนี้เลย

นพ.นิรันดร์กล่าวอีกว่า หลังจาก กสม.รับเรื่องนี้มาจากสำนักงานคณะกรรมการกฤษฎีกา กสม.พยายามทำหนังสือคัดค้านความเห็นดังกล่าว ปรากฏว่านอกจากทางกฤษฎีกาไม่ยอมฟังคำชี้แจงและคัดค้านแล้ว กลับส่งเรื่องไปให้ ครม.พิจารณาทันที กสม.จึงต้องหารืออย่างเร่งด่วนกับผู้ที่เกี่ยวข้องเพื่อหาทางแก้ปัญหาเรื่อง นี้ เพราะเห็นว่าเป็นเรื่องไม่ถูกต้องอย่างมากที่องค์กรอิสระถูกกีดกันและจำกัด การทำงาน โดยเฉพาะการให้ข้อมูลกับสื่อเช่นนี้ จึงต้องเชิญนักกฎหมายจากหลายภาคส่วนมาหารือเพื่อหาทางแก้ปัญหาเรื่องนี้

นางสุนี ไชยรส อดีต กสม. ในฐานะคณะทำงานยกร่าง พ.ร.บ.กสม.กล่าวว่า การเพิ่มมาตรา 43 เข้ามาทำให้เกิดความวุ่นวายเรื่องการฟ้องร้องและการตีความ ทำให้เรื่องที่พิจารณาเกิดความล่าช้าออกไปอีก จากเดิมที่ล่าช้าอยู่แล้ว และความจริงแล้วคณะกรรมการกฤษฎีกาไม่ควรเข้ามายุ่งเกี่ยวกับเนื้อหาและรายละ เอียดกับกฏหมายขององค์กรอิสระ โดยเฉพาะของ กสม. หากเห็นว่าเรื่องไหนข้อใดไม่ถูกต้องก็ให้เป็นหน้าที่ของรัฐสภาเป็นผู้ พิจารณาแก้ไข อย่างไรก็ตาม ร่าง พ.ร.บ.กสม.ที่ผ่านการทำประชาพิจารณาหลายรอบมาก คิดว่าน่าจะสมบูรณ์ที่แล้ว แต่ถูกกฤษฎีกาแก้ไขอย่างมาก นอกจาก 2 ข้อที่น่ากังวลดังกล่าวแล้ว ยังตัดกองทุน กสม.ทิ้งอีกด้วย โดยไม่ให้เหตุผลอะไรเลย

ผู้สื่อข่าวรายงานว่า นอกจาก กสม.ชุดเก่า และชุดปัจจุบัน ร่วมกับนักกฎหมายจากหลายสถาบันที่จะประชุมหาทางออกเรื่องที่กฤษฎีกาแก้ร่าง กฎหมายใน 3 มาตราแล้ว ที่ประชุมจะหารือเรื่องการเสนอให้เปลี่ยนที่มาของคณะกรรมการสรรหาทั้ง 7 คน ให้ตัดตัวแทนจากที่ประชุมใหญ่ของศาลปกครอง และศาลฎีกา เป็นตัวแทนจากภาคประชาชน อย่างไรก็ตาม เป็นที่น่าสังเกตด้วยว่านอกจากการห้าม กสม.ให้ข้อมูลแล้วแล้ว กฤษฎีกาได้เพิ่มอำนาจให้ กสม.ยื่นเรื่องฟ้องศาลรัฐธรรมนูญ (มาตรา 44) ศาลปกครอง (มาตรา 45) ศาลยุติธรรม (มาตรา 46) สำนักงานจะแต่งตั้งให้พนักงานอัยการหรือทนายความเป็นผู้ดำเนินคดีแทนก็ได้ใน การดำเนินคดีแทนผู้เสียหายในศาล ให้สำนักงานมีอำนาจฟ้องเรียกทรัพย์สินหรือค่าเสียหายให้แก่ผู้เสียหายได้ เป็นต้น

อนึ่ง หลังจากมีการแก้ไขรัฐธรรมนูญ 2540 เป็นรัฐธรรมนูญ 2550 ทาง กสม.ต้องแก้ไข พ.ร.บ.กสม.พ.ศ.2542 ให้สอดคล้องกับกฎหมายฉบับใหม่ กสม.ชุดเก่าจึงตั้งอนุกรรมการขึ้นมายกร่างแก้ไข เมื่อร่างเสร็จก็ได้ประชุมรับฟังความคิดเห็นและแก้ไขจนทุกฝ่ายที่เกี่ยวข้อง ยอมรับแล้ว จึงส่งให้คณะกรรมการกฤฎีกาตีความตามขั้นตอน ระหว่างนั้น กสม.ชุดเก่าก็หมดวาระลง แต่ล่าสุดเมื่อ 1 เดือน ที่ผ่านสำนักงานคณะกรรมการกฤษฎีกาได้ส่งข้อแก้ไขตัวร่าง พ.ร.บ.ดังกล่าวกลับมา และมีการแก้ไขสาระสำคัญหลายประการ

A Statement by the Asian Human Rights Commission
THAILAND: New NHRC chief promises to ensure that human rights body is meaningless and irrelevant

In an interview posted on the website of the National Human Rights Commission (NHRC) of Thailand, the commission’s new chairwoman, Amara Pongsapich, has effectively promised to make the national rights institution meaningless and irrelevant, other than as an obstacle to human rights. Throughout the process of selecting and appointing the new commission’s seven members, who include among their ranks a named human rights violator, a policeman and a court administrator, the Asian Human Rights Commission (AHRC) made clear that this would be the consequence of their appointment. In the interview (‘On the Record: New NHRC embraces spirit of cooperation’, from the Bangkok Post, 21 July 2009), the new chairwoman makes plain that the role of the commission is now no longer one of human rights defender but human rights perpetrators’ defender.

In this statement, the AHRC responds with remarks on some contents of the interview, following questions and answers in the original text.

Q. How do you explain local and regional comments on the non-participatory selection process of your commission?

A. The process was in line with the 2007 constitution, which stipulates that a seven-member panel would be set up to nominate seven prospective commissioners for Senate endorsement.

AHRC comment: The answer is correct. The 2007 Constitution is undemocratic and was introduced through a military coup to reduce the effectiveness of parliamentary government in Thailand. Therefore, it is not surprising that this non-human rights commission is the result of its process. It is also the case that as a result the NHRC is no longer a National Human Rights Institution under the terms of the international Paris Principles. For this reason the AHRC has written to the agency responsible for monitoring compliance with the principles to see that the NHRC is downgraded and is prohibited from participating in United Nations forums.

Q. When did the line-up get royal endorsement and how were you selected as chairwoman?

A. … We agreed to delegate works according to experience and the interests of each commissioner. For example, former senator Niran Pitakwatchara will liaise with people’s movements while Pol Gen Wanchai and Paiboon Warahapaitoon will take charge of legal and judicial procedures.

AHRC comment: A police general has been assigned the responsibility of dealing with police abuses. This is a great tradition in Thailand, where police have also been appointed to the justice and interior ministries to protect their peers against allegations that they have violated human rights. It is the reason that this general was appointed to the commission, and from all accounts so far he has been doing a very good job at this. In other words, the NHRC is now being used as an agency to defend violators of rights and demoralize victims. Apparently the chairwoman does not find this ironic or strange, which also goes to show how little understanding she has of the fundamentals of human rights work, as opposed to human rights theory of the sort with which she might have become familiar at university.

Q. Are you worried about working relations among the commissioners since they have different backgrounds? How will your panel work efficiently?

A. Well, we acknowledge the diversity and we put everything on the table.

AHRC comment: This question might have been put as a joke. The answer certainly is a joke. In fact, the commission consists of four persons from the government and only three from other sectors, one of whom is a businessman who admires the military regime in Burma. None of the members have personal hard experience of fighting for human rights, as did at least one of the members in the former commission. A less diverse group would be hard to find.

A. We have also overhauled the NHRC’s working structure, such as reducing the number of sub-committees and splitting up some bureaus to improve the commission’s performance.

AHRC comment: The subcommittees were one of the few parts of the former commission where real work on human rights was done. Some of the people on the subcommittees dedicated long hours investigating violations, and preparing and tabling reports for action at personal expense and considerable effort. Scrapping subcommittees is another sure way to reduce the output of the commission and make it less effective.

Q. There is a concern that the new NHRC will be less aggressive and too lenient in cases involving state agencies because it is comprised mainly of former bureaucrats.

A. There are both advantages and disadvantages in having bureaucrats on this commission. The bureaucratic style will change the image of the NHRC from an anti-government or NGO-like body to a softer accommodative mechanism. But the weakness is we will have less access to the grass roots. That’s why we need to adapt our solo working style to be collaborative with a networking entity.

AHRC comment: Here the real purpose of assigning bureaucrats and academics to run the NHRC becomes clear. It is in the fraudulent idea that a softly-softly approach to human rights of the sort that has been used for years in Thailand to entrench the status quo is the future for the commission. It signifies a return to old elite habits and away from a so-called anti-government approach associated with non-government organisations. That approach, the chairwoman implies, is not good and not the right way for Thai people, who surely would prefer to have a more bureaucratic NHRC in accordance with the cultural expectations that the elite have assigned to them.

Q. How will the NHRC undertake the significant mandate of filing a lawsuit against human rights violators?

A. The commission will not be acting as a law office, filing individual cases, but will create an environment for concerned agencies to work together.

AHRC comment: One of the things that apologists for the 2006 coup pointed to in the new constitution was that it would give the NHRC the power to file cases in court (section 257, para. 4). Now the new chairperson indicates that she has no interest to exercise this power. Instead her commission will just “create an environment”. In the next part of her answer she tries to explain what that means.

A. Through the NGO and grass-roots networking and cooperation with various law enforcement agencies, as well as our own research and academic arms, legal action could be handled by those respective agencies in a more coordinated and effective manner.

AHRC comment: First the chairwoman doesn’t like the non-government organisations’ approach and implicitly denigrates them for being anti-government in style on human rights. Then she says that her commission will find a way to make them all cooperate together. Here again is the giant fraud that has for years been used by the elite in Thailand, of which the chairperson is a member, to co-opt and emasculate civil society groups and thereby deny the emergence of a genuine human rights movement in the country. The chairwoman is in this respect no more than another part in a desperate strategy for continued elite control of the human rights discourse and agenda in Thailand, against the real meaning of human rights.

Q. How will the Asean human rights mechanism and the National Human Rights Commission work?

A. There are some worries that the regional human rights body might not be strong enough. But I think we should have it first and shape it later. I don’t think there will be overlapping areas of work between the national human rights body and the Asean body, which should take up regional issues such as the Rohingya displaced people better than the NHRC.

AHRC comment: Naturally, a hard issue like the Rohingya refugees (as human rights commissioner it would not be right to call them refugees; better to say “displaced people”) will not be addressed through the NHRC because its approach is bureaucratic, soft and accommodating. Therefore, it will be left to the as-yet non-existent regional mechanism of the Association of Southeast Asian Nations, which also will do nothing. Here one of the real purposes of the ASEAN human rights body is clearly revealed for the first time: it is intended as a place for useless national human rights institutions to shift responsibilities and avoid blame coming to national authorities when people’s rights are not protected. This can be expected to happen a lot in the coming years, especially in cases coming from the meaningless and irrelevant National Human Rights Commission of Thailand.

ตามที่นางอมรา พงศาพิชญ์ ประธานคณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) ได้แถลงข่าวต่อสื่อมวลชน เมื่อวันที่ ๑๕ กรกฎาคม ๒๕๕๒ ว่า ได้มอบนโยบายให้เจ้าหน้าที่กสม. ความว่า “ …………นอกจากนี้ ยังต้องปรับวิธีทำงาน โดยจะไม่ให้กสม. เป็นเอ็นจีโอระดับชาติ หรือเป็นสำนักงานทนายความ อีกทั้ง จะไม่แก้ปัญหา หรือส่งฟ้องเป็นรายๆ แต่ต้องไปให้ไกลกว่านั้น………..” และยังกล่าวอีกว่า “ ……….รวมทั้งยังต้องปรับ ยุทธศาสตร์การทำงานใหม่ด้วย เพื่อให้ กสม.เป็นองค์กรอิสระที่แท้จริง ไม่ใช่เอ็นจีโอ และจะได้ไม่ถูกมองว่า ทำหน้าที่เหมือนเป็นฝ่ายค้าน อย่างที่ผ่านมา” ดังเป็นที่ทราบโดยทั่วไปนั้น

คณะกรรมการประสานงาน องค์กรพัฒนาเอกชน (กป.อพช.) ซึ่งเป็นเครือข่ายองค์กรพัฒนาเอกชน หรือเอ็นจีโอทั่วประเทศ มีความเห็นว่า การมอบนโยบายให้เจ้าหน้าที่กสม.ดังกล่าว เป็นทัศนะที่อาจเป็นอันตราย ต่อการทำงานสิทธิมนุษยชน ในสังคมไทย ด้วยเหตุผล ดังนี้

ประการแรก  เป็นการโน้มนำ เหมารวมให้สาธารณชน หรือผู้คนในสังคม หลงคิดและหลงเชื่อว่า “การเป็นเอ็นจีโอ” เป็นสิ่งที่ไม่พึงประสงค์ สำหรับการทำงานด้านสิทธิมนุษยชน ทั้งๆที่ ไม่อาจอธิบายได้ว่า “การเป็นเอ็นจีโอ” มีนิยามความหมายเช่นไร หรือการทำงานของเอ็นจีโอ มีความเป็นปฏิปักษ์ กับการปกป้องสิทธิมนุษยชนอย่างไร เพียงใด ทั้งที่โดยแท้จริงแล้ว เอ็นจีโอส่วนใหญ่ กำลังทำงานด้านสิทธิมนุษยชน ในหลากหลายมิติ ทั้งการช่วยเหลือแก้ไขปัญหาเฉพาะหน้า  การให้ความรู้ สร้างจิตสำนึก หรือการรณรงค์ผลักดันนโยบาย และกฎหมายด้านสิทธิมนุษยชน รวมทั้งประเด็นที่ไม่ควรหลงลืม หรือตัดตอนความทรงจำ ทางประวัติศาสตร์เป็นอันขาด ก็คือ การเกิดขึ้นของ คณะกรรมการสิทธิมนุษยชนแห่งชาติ เป็นผลิตผลหนึ่งของการต่อสู้ ผลักดัน ขององค์กรสิทธิมนุษยชนนั่นเอง

ประการที่สอง  เป็นความเข้าใจผิดอย่างมหันต์ ที่ไปเข้าใจว่า การตรวจสอบรัฐบาล ในการละเมิดสิทธิมนุษยชน เป็นการ “ทำหน้าที่เหมือนฝ่ายค้าน” เพราะถือเป็นภารกิจขั้นพื้นฐานของรัฐ ที่ต้องเคารพ ปกป้อง คุ้มครอง และการดำเนินการ ให้เกิดสิทธิที่เป็นจริง เพื่อให้สิทธิของประชาชน ได้รับการประกันอย่างแท้จริง อันเป็นความรู้ปฐมบท เกี่ยวกับหลักการสิทธิมนุษยชน ที่เป็นที่รับรู้กันโดยทั่วไป ด้วยเหตุนี้ เมื่อคณะกรรมการสิทธิมนุษยชนแห่งชาติ ต้องทำหน้าที่สำคัญประการหนึ่ง ในการคุ้มครองสิทธิเสรีภาพของประชาชน จึงจำต้องเชื่อมโยง การละเมิดสิทธิ เข้ากับภาระความรับผิดชอบของรัฐ ต่อสิทธิมนุษยชนอย่างไม่อาจเลี่ยงพ้น หรืออาจกล่าวได้ว่า รัฐไม่สามารถหลีกเลี่ยงพันธกรณีใดๆ เกี่ยวกับการละเมิดสิทธิมนุษยชน ที่เกิดขึ้นในสังคม ดังนั้น ความไม่รู้หรือไม่เข้าใจ ถึงความสัมพันธ์ระหว่างหน้าที่ของรัฐ กับสิทธิมนุษยชน นอกจากจะเป็นการละเลย เพิกเฉย หรือไม่ตระหนัก ต่อหลักการสิทธิมนุษยชน อย่างเพียงพอแล้ว ยังอาจมีความโน้มเอียง ที่จะทำหน้าที่ปกป้อง หรือเข้าข้างเพื่อแก้ต่างให้รัฐ มากกว่า การคุ้มครองสิทธิของประชาชน

ประการที่สาม เป็นความเข้าใจที่ผิด เกี่ยวกับความเป็นองค์กรอิสระ ของคณะกรรมการสิทธิมนุษยชนแห่งชาติ ที่เชื่อว่า “ต้องปรับยุทธศาสตร์การทำงานใหม่ด้วย เพื่อให้ กสม. เป็นองค์กรอิสระที่แท้จริง ไม่ใช่เอ็นจีโอ” เนื่องด้วยความเป็นองค์กรอิสระ ของคณะกรรมการสิทธิมนุษยชนแห่งชาติ มีความหมายสองระดับ คือ ความหมายในระดับความคิด และจิตวิญญาณ ที่ต้องปลอดจากการครอบงำทางความคิด ความเชื่อ และทัศนคติ แบบอำนาจนิยมและระบบอุปถัมภ์ ที่ดำรงอยู่อย่างเหนียวแน่น ในหมู่บุคคล หน่วยงาน สถาบัน หรือองค์กรที่ใช้อำนาจรัฐทั้งหลาย รวมทั้งในวิถีชีวิตของผู้คนในสังคมไทย สำหรับความหมายในอีกระดับ คือ การปฏิบัติหน้าที่ตามภารกิจ ในการส่งเสริม และคุ้มครองสิทธิมนุษยชน ที่ต้องมีความเป็นอิสระ ปลอดจากการครอบงำ แทรกแซง จากบุคคล หน่วยงาน หรือสถาบัน ที่มักจะละเมิดสิทธิมนุษยชนอยู่เสมอๆ แต่คณะกรรมการสิทธิมนุษยชนแห่งชาติ จะต้องไม่มีความเป็นอิสระ จากการละเมิดสิทธิมนุษยชน และผู้คนที่ถูกละเมิดอย่างเด็ดขาด ดังนั้น ความหมายของความเป็นองค์กรอิสระโดยแท้จริง จึงหาได้หมายความถึง ความใช่หรือไม่ใช่ เอ็นจีโอแต่อย่างใด เพราะคณะกรรมการสิทธิมนุษยชนแห่งชาติ และเอ็นจีโออาจ เป็นหรือไม่เป็นองค์กรอิสระโดยแท้จริง ตามความหมายที่กล่าวมา ก็ได้ และหากทั้งสององค์กร ไม่เป็นองค์กรอิสระโดยแท้จริงเสียแล้ว ถึงจะมีการดำรงอยู่ของ คณะกรรมการสิทธิมนุษยชนแห่งชาติ และเอ็นจีโอ ก็จะไม่มีความหมาย และไม่ยังประโยชน์ในการรังสรรค์ และพัฒนาสิทธิมนุษยชน ให้มั่นคงในสังคมไทย แต่ประการใด

นางอริณณพงศ์ สูตรสุคนธ์ เลขาธิการ คณะกรรมการสิทธิมนุษยชนแห่งชาติ เปิดเผยว่า ขณะนี้มีพระบรมราชโองการโปรดเกล้าฯ คณะกรรมการสิทธิมนุษยชนแห่งชาติ ชุดใหม่ เป็นที่เรียบร้อยแล้ว โดยพระบรมราชโองการ ได้ลงวันที่ 25 มิ.ย. ที่ผ่านมา โดยเบื้องต้นตนได้ประสานไปยัง คณะกรรมการสิทธิฯชุดใหม่ และคาดว่า จะประชุมนัดแรกได้ภายในสัปดาห์นี้ อย่างไรก็ตาม ทางสำนักงานต้องรอดูนโยบาย ของกรรมการสิทธิฯชุดใหม่ ว่าจะเป็นอย่างไร แต่เรื่องงานโดยทั่วไป นั้นก็เป็นงานที่สานต่อจาก กรรมกการสิทธิฯชุดที่เพิ่งผ่านพ้นไป

ขณะที่ น.พ.นิรันดร์ พิทักษ์วัชระ กรรมการสิทธิฯ เปิดเผยว่า ตนเพิ่งรับทราบเรื่องในวันนี้ ซึ่งคาดว่า ในวันพรุ่งนี้จะได้รับการประสานงาน จากทางสำนักงานเพื่อให้เข้ามาประชุมนัดแรก ในวันพฤหัสบดีที่ 2 ก.ค. นี้ และส่วนตัวอยากเข้ามาดูแลงาน ด้านสิทธิชุมชน

A written statement submitted by the Asian Legal Resource Centre (ALRC), a non-governmental organisation with general consultative status

THAILAND: NHRC not independent nor composed according to international standards

1. In its previous written submission to the Human Rights Council, the Asian Legal Resource Centre (ALRC) pointed to the resurgence of regressive anti-human rights forces in Thailand in the wake of the 2006 military coup as a grave threat to human rights in that country. It identified the repeated overthrow of elected governments by antidemocratic forces, large-scale criminal activity not followed with investigations or prosecutions, Internet censorship, use of the draconian criminal law to hunt critics of government and monarchy and threats to human rights defenders as just some of the challenges in the current period.

2. A specific consequence of the increasing disregard for human rights and human rights institutions in Thailand that has emerged since the last session of the Council, and one which should be of special concern to the global human rights community, is the appointment of new commissioners to the National Human Rights Commission (NHRC) of Thailand in disregard to the Principles Relating to the Status of National Institutions on Human Rights (The Paris Principles).

a. Briefly, the terms of the previous commissioners in fact lapsed during 2007, under the interim military-appointed government; however, most of the commissioners continued in their posts under the NHRC Act (1999), which provided that they were to do so until a new commission was appointed.

คณะกรรมการสิทธิมนุษยชนแห่งชาติ ชุดใหม่ ที่ได้รับความเห็นชอบจากวุฒิสภา จำนวน 7 คน ประกอบด้วย พล.ต.อ.วันชัย ศรีนวลนัด นางอมรา พงศาพิชญ์ น.พ.แท้จริง ศิริพานิช น.พ.นิรันดร์ พิทักษ์วัชระ นายไพบูลย์ วราหะไพฑูรย์ นายปริญญา ศิริสารการ และนางวิสา เบ็ญจะมโน ได้มาประชุมรวมกันเพื่อคัดเลือกประธาน ก่อนที่จะนำรายชื่อประธานและคณะกรรมการฯ ขึ้นทูลเกล้าฯ เพื่อมีพระบรมราชโองการโปรดเกล้าฯ แต่งตั้งต่อไป นั้น

โดยที่ประชุมได้วางกรอบการคัดเลือก และให้ใช้การลงคะแนนลับ ทั้งนี้ ได้มีการเสนอชื่อผู้เป็นประธานฯ 2 คน คือ นางอมรา พงศาพิชญ์ และ พล.ต.อ.วันชัย ศรีนวลนัด ผลปรากฏว่า นางอมรา ได้รับคัดเลือกให้เป็นประธาน ด้วยคะแนน 4:3 เสียง โดยหลังจากนี้ เลขาธิการคณะกรรมการสิทธิฯ จะแจ้งเรื่องไปยังประธานวุฒิภาในวันพรุ่งนี้ เพื่อดำเนินการตามขั้นตอนต่อไป

นางอมรา ให้สัมภาษณ์ภายหลังได้รับคัดเลือกว่า ยอมรับว่า หนักใจ เพราะรัฐธรรมนูญฉบับใหม่ ให้อำนาจกับคณะกรรมการสิทธิฯ ค่อนข้างมาก แต่ปรับลดจำนวนคนลงจากเดิม 11 คน เหลือเพียง 7 คน ทั้งนี้ หากได้รับโปรดเกล้าฯเมื่อใด ก็จะเข้ามาเรียนรู้งาน และโครงสร้างของสำนักงานคณะกรรมการสิทธิฯ ว่าควรจะมีการปรับเปลี่ยนแนวทาง ในการทำงานให้เหมาะสมอย่างไร รวมถึงจะมาแบ่งแนวทางการรับผิดชอบของแต่ละคนด้วย โดยอาจดูตามความถนัด อย่างไรก็ตาม เราไม่อยากให้รัฐบาลเข้ามาแทรกแซงการทำงาน แต่ในขณะเดียวกัน เราก็มีภารกิจที่จะต้องผลักดันให้รัฐบาล ทำตามข้อเสนอของเรา

An Open Letter to the International Coordinating Committee of National Institutions for Human Rights by the Asian Human Rights Commission (AHRC)

Dear Ms. Lynch

THAILAND: NHRC no longer complies with Paris Principles, must lose status in United Nations forums

The Asian Human Rights Commission (AHRC) is writing to you to request an immediate review of the status of the National Human Rights Commission (NHRC) of Thailand on the basis that it no longer complies with the Principles Relating to the Status of National Institutions on Human Rights (The Paris Principles) and must be downgraded so that it is unable to participate in the United Nations.

As you will be aware from the contents of three previous open letters that the AHRC addressed to the Senate of Thailand and copied to you (AHRC-OLT-012-2009; AHRC-OLT-013-2009; AHRC-OLT-015-2009), the Senate was to vote on the seven nominees to the commission on last Friday, May 1. Regrettably, the Senate proceeded with the vote and all seven of the nominees were approved for appointment as commissioners.

It is the opinion of the AHRC that the selection and composition of this NHRC fails in every respect to comply with the Paris Principles, specifically, section 1 of the principles on composition and guarantees of independence and pluralism, which reads that:

“The composition of the national institution and the appointment of its members, whether by means of an election or otherwise, shall be established in accordance with a procedure which affords all necessary guarantees to ensure the pluralist representation of the social forces (of civilian society) involved in the protection and promotion of human rights, particularly by powers which will enable effective cooperation to be established with, or through the presence of, representatives of: (a) Non-governmental organizations responsible for human rights and efforts to combat racial discrimination, trade unions, concerned social and professional organizations, for example, associations of lawyers, doctors, journalists and eminent scientists…”
