ใครควรเป็น คณะกรรมการสิทธิมนุษยชน แห่ง ประเทศไทย
คณะกรรมการสิทธิมนุษยชนแห่งประเทศไทย ชุดปัจจุบัน ได้ครบวาระ ตั้งแต่วันที่ 12 กรกฎาคม 2550 ปัจจุบันจึงทำหน้าที่รักษาการเท่านั้น เนื่องจากก่อนหน้านี้ ไม่มีวุฒิสภาที่จะมาทำหน้าที่ในการสรรหา และแต่งตั้งคณะกรรมการสิทธิฯชุดใหม่
แต่เมื่อวันที่ 2 มีนาคม 2551 ประเทศไทยได้มีสมาชิกวุฒิสภาครบถ้วน ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.2550 แล้ว ดังนั้น กระบวนการสรรหาคณะกรรมการสิทธิฯชุดใหม่ จึงน่าจะเกิดขึ้นอีกไม่นาน นับแต่นี้ ซึ่งในระหว่างนี้ได้เริ่มจัดทำร่างแก้ไขกฎหมาย “พระราชบัญญัติว่าด้วย คณะกรรมการสิทธิมนุษยชนแห่งชาติ” ให้สอดรับกับ รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.2550 มาตรา 256 และ มาตรา 257 เมื่อแก้กฎหมายเสร็จ ก็จะเริ่มกระบวนเฟ้นหาบุคคล ที่จะมาเป็นคณะกรรมการสิทธิฯชุดต่อไป
รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.2550 ได้บัญญัติไว้ว่า
“มาตรา 256 คณะกรรมการสิทธิมนุษยชนแห่งชาติ ประกอบด้วย ประธานกรรมการคนหนึ่ง และกรรมการอื่นอีกหกคน ซึ่งพระมหากษัตริย์ทรงแต่งตั้ง ตามคำแนะนำของวุฒิสภา จากผู้ซึ่งมีความรู้ หรือประสบการณ์ ด้านการคุ้มครองสิทธิเสรีภาพของประชาชน เป็นที่ประจักษ์ ทั้งนี้ โดยต้องคำนึงถึง การมีส่วนร่วมของผู้แทน จากองค์การเอกชน ด้านสิทธิมนุษยชนด้วย…”
คณะกรรมการสิทธิมนุษยชน เป็นองค์กรที่มีบทบาทสำคัญในสังคมไทย ในการสนับสนุน ส่งเสริม คุ้มครอง และปกป้องสิทธิมนุษยชน ของประชาชนชาวไทย มีหน้าที่ตรวจสอบการกระทำ ของภาครัฐและภาคเอกชน ที่กระทำละเมิดสิทธิมนุษยชนต่อประชาชน ดังนั้น คุณสมบัติ ของผู้ที่จะเป็นคณะกรรมการสิทธิฯ จึงมีความสำคัญยิ่ง ต่อประชาชนและสังคมไทย เพราะบุคคลทั้ง 7 คนนี้ จะต้องทำหน้าที่อยู่นาน ถึง 6 ปี หากได้ผู้ซึ่งไม่พร้อมที่จะทำหน้าที่ ตามที่รัฐธรรมนูญให้อำนาจไว้ ก็จะก่อให้เกิดปัญหา แก่ผู้ที่ถูกละเมิดสิทธิอย่างยิ่ง และจะกลายเป็นองค์กรที่ไร้ประโยชน์
บล็อคนี้จึงถูกสร้างขึ้นมา เพื่อใช้ในการรณรงค์เรียกร้อง ให้ทุกคนหันมา ตระหนักถึงความสำคัญ ในการสรรหาคณะกรรมการสิทธิมนุษยชน ชุดต่อไป ตั้งแต่เริ่มต้นของกระบวนการ ด้วยการติดตาม การแก้พรบ.คณะกรรมการสิทธิมนุษยชน และที่สำคัญที่สุด ก็คือ กระบวนการเสนอชื่อบุคคล เพื่อให้ได้รับการสรรหา เป็นคณะกรรมการสิทธิฯ “ใครควรเป็น คณะกรรมการสิทธิฯ” ทั้งนี้ เพื่อประเทศไทยจะได้มี คณะกรรมการสิทธิมนุษยชน เป็นอีกองค์กรหนึ่ง ที่ทำงานเพื่อปกป้อง คุ้มครอง และส่งเสริมสิทธิมนุษยชน ด้วยความเข้มแข็งและมีประสิทธิภาพ
เราต้องการความคิดเห็น ข้อเสนอแนะ จากท่าน รวมทั้งการร่วมกัน เสนอชื่อบุคคล ที่ท่านคิดว่า ควรจะมาทำหน้าที่ เป็นคณะกรรมการสิทธิมนุษยชน ในชุดต่อไป เพื่อร่วมกันรณรงค์หา “คณะกรรมการสิทธิมนุษยชน ที่ควรจะเป็น” ของประเทศไทย
We need a good debate!
On March 2, 2008 the second half of the Thai senate was elected. The elected senators will join soon with those appointed by a group of judges and bureaucrats.
Among the things they will do is pass an amended law for the National Human Rights Commission (NHRC) of Thailand. Then, seven new commissioners will be appointed.
There is a danger that seven people who don’t really care about human rights or have records of really working on human rights could be appointed without anyone knowing about it. Then we will be stuck with seven useless commissioners for the next six years.
Who should be a member of the NHRC? According to the 2007 Constitution
“The National Human Rights Commission consists of a president and six other members appointed by the King with the advice of the Senate from persons having apparent knowledge and experience in the protection of the rights and liberties of the people, having regard also to the participation of representatives from private organizations in the field of human rights.” (Section 256)

I think it’s best to not expect too much from a “half-appointed” senate. After all why should we screw up a good thing as human rights abuses in this country has already been engrained in our societyfor decades in order that Thai authroities can continue to indirectly control the people?
If Thai civil society and the press refuse to keep human rights abuses as the number one topic in Thai society, then even the worthy efforts of the Asian Human Rights Commission is due for failure.

Preeda — yes, looking at the “half sail” senate and all the other stuff going on there’s not much cause for optimism, but that’s also exactly why we need to get people thinking about NHRC right now. A NHRC with 2-3 good members at least will be better than no NHRC at all. Human rights abuses, unfortunately, are not a number one topic anywhere in the world, but with this much they can at least still be a topic.
Who would you nominate? Any ideas?
